Q1. When you are under arrest, do you have the right to one free telephone call?

No. There is no law stating that they have to allow you a phone call. However the police will generally let you make a call and you should always ask. The police should not stop you from contacting a solicitor.

Q6.Can you be charged if you walk home from a party after drinking a lot of alcohol ?

YES. It is illegal at any age to be drunk in public. You may be charged and made to appear in court.

Q2. Do you have the right to see your school files?

Yes. there are many files the school will keep on you and you have a right to view all of these files. You may need to apply under the Freedom of Information Act.

 

Q7. If someone gives you a pair of shoes which you know are stolen, can you be charged?

Yes. You can be charged for receiving stolen property if you know the shoes have been stolen.

Q3.Can you be charged for assault if you have a fight during a game of football?

Yes. Although we see many fights on TV which do not lead to charges, there have been some people in Brisbane charged with assault during sporting matches. 

Q8. How old do you need to be to get a full-time job?

15 years old. As you must be in school until you turn 15 years old, you can not get full time employment unless you have permission from the Department of Education. If you are under 15 years old, you can get a part-time job outside of school hours.

Q4.How old do you need to be before you can be charged for a criminal offence?

10 years old. Once you have turned 10 years old you can be charged for criminal offences as a juvenile. If you offend after you turn 17 years old you will be charges as an adult.

Q9.If your boss sacks you because you are pregnant, can you do something about it?

Yes. There are anti-discrimination laws which prevent employers from sacking people without good reason. You can contact the Queensland Anti-Discrimination Commission for more information.

Q5.If the police wish to search you because they think you have drugs on you, do they need a warrant?

No. Under the Drugs Misuse Act, if the police have reason to suspect that you have drugs on your person, then they have the power to search you and your bag without a warrant. They can also strip search you if they think you have drugs hidden under your clothes.

Q10.If you are shopping with a friend and you know they are stealing a chocolate bar, can you be charged?

If the police believe you have assisted your friend to steal, then you can be charged. Assisting could be as simple as warning your friend of security. Being a lookout is like being an accessory to the crime. In Queensland you are charged with the same offence, in this case you could be charged for Stealing'.
