![]() Police Search Powers
If police have a ‘reasonable suspicion’ that someone has drugs, they are allowed to search without a warrant (person, car, house). (Remember that there are also other reasons that would allow Police to search you without a warrant.)
‘Reasonable suspicion’ may be based on such things as a person looking/acting drug affected or smelling of drugs.
If police don’t have reasonable suspicion, they may still ask if they can search you (“Can you turn out your pockets?” or “Can I look in your bag?”).
You do not have to agree to a search and you can ask the police what their ‘reasonable suspicion’ is based on if they say they don’t need your consent for a search.
